Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Tool Shed LLC("Tool Shed", "we", "us"). They apply to your use of this website and to every order you place with us. By using the site or placing an order you agree to these Terms, our Privacy Policy, Shipping Policy and Return & Refund Policy. If you do not agree, do not use the site.

Who may buy

You must be at least 18 years old, or buying under the supervision of an adult, and able to form a binding contract. We sell for delivery within the United States only. Our products are tools and abrasives intended for users who have the training and protective equipment needed to use them safely (see Product information and safe use).

Orders and acceptance

• When you place an order we email you a confirmation. That email confirms we received your order. We accept it when we ship the items or tell you we have accepted it.
• We may refuse or cancel an order, for example because an item is out of stock, a price or description contains an error, we cannot verify your payment, or we suspect fraud. If we cancel an order after you have paid, we refund the full amount.
• If we cannot ship by the date we promised, we will tell you and give you the option to cancel for a full refund.
• You can ask to cancel an order before it ships by emailing support@toolshedshop.com. After it ships, use our return process.

Prices, taxes and payment

• All prices are in United States dollars (USD).
• Sales tax is calculated at checkout based on where the order is delivered and is shown as a separate line before you pay. Prices shown on product pages do not include sales tax.
• Shipping costs are shown before you pay. Orders of $80or more ship free (before tax), as described in our Shipping Policy. There are no other fees added at checkout or on delivery.
• We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay. Your payment method is charged when you place your order.
• Prices and availability can change without notice. The price you pay is the price shown when you place the order. If we find an obvious pricing error we will contact you and let you confirm the order at the correct price or cancel it for a full refund.

Shipping, delivery and risk of loss

We ship from the United States. Orders are processed in 2-5 business days and usually arrive 7-14 business days after shipment. These are estimates, not guarantees. Risk of loss and title pass to you when the carrier delivers the order to the address you gave us. If your order arrives damaged or goes missing, contact us promptly and we will help. Returns and refunds

You may return most items within 30 days of delivery for a refund. Returns are free. Used or mounted cutting, grinding and flap wheels and discs cannot be returned. Our Return & Refund Policy explains the process and is part of these Terms.

Product information and safe use

• We work to describe and photograph products accurately, but colors, packaging and minor details can differ, and we do not promise that descriptions are error-free.
• Cutting wheels, grinding wheels, flap discs, saw blades, files and sanding products can cause serious injury if misused. Before using any product you must read and follow our Safety Information, the markings on the product and its packaging, and the instructions for your tool.
• You are responsible for choosing a product that suits your tool and task (including size, arbor size and maximum speed), for using it with the correct guard and protective equipment, and for training anyone who uses it.
• Do not use a product for a purpose it was not designed for, at a speed above the maximum marked on it, or if it is damaged.
• Some products may require warnings under California Proposition 65. Where that applies the warning is shown on the product page.

Warranty disclaimer

We stand behind our products if they arrive defective or are not what you ordered; contact us and we will repair the problem through a replacement or refund. Apart from that, and to the fullest extent the law allows, products are sold "as is", and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow limits on implied warranties, so this may not apply to you. You may also have other rights that vary by state.

Limitation of liability

To the fullest extent the law allows, Tool Shed LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business, arising from your use of the site or the products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud, or for a defective product where your state's law does not allow the limitation.

Using this website

You agree not to:

• use the site unlawfully or to commit fraud,
• interfere with or try to break the site's security,
• use bots or scrapers to collect content or prices without our written permission,
• buy for resale in a way that circumvents quantity limits we have posted.

The site may link to other websites. We do not control them and are not responsible for their content. We may suspend or end access to the site if you break these Terms.

Intellectual property

The text, images, logos and design of this site belong to Tool Shed LLC or its licensors and are protected by law. You may view and print pages for your own personal use when shopping, but you may not copy, republish or sell them without our written permission. Third-party names and standards mentioned on the site are used only to identify them and belong to their owners.

Governing law and disputes

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-law rules, and by applicable federal law. If we cannot resolve a dispute informally, it will be handled in the state or federal courts located in Middlesex County, Massachusetts, and you and we consent to those courts. This does not take away any consumer protection rights you have under the law of the state where you live, and either of us may bring a claim in small claims court. Before any claim, please contact us first at support@toolshedshop.com so we can try to fix it.

California consumer notice

Under California Civil Code section 1789.3, California users are entitled to the following notice: Tool Shed LLC provides this website. If you have a complaint, contact us at support@toolshedshop.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Changes to these terms

We may update these Terms. The version in effect when you place an order applies to that order. The "Last updated" date above shows the current version. If you keep using the site after a change, you accept the new Terms.

If a part of these Terms is found unenforceable, the rest stays in effect. These Terms, with the policies they refer to, are the entire agreement between you and us about your use of the site and your orders.
